6) Location; Setup; Surface Requirements; Power; Permissions; Additional Fees
Primary Intended Setup: The Prize is intended for residential grass setup with ground stakes. Ground stakes are mandatory where permitted and feasible, unless Sponsor approves an alternative anchoring method in writing.

- Adequate clear space for equipment footprint and safe use zone;
- Safe access for delivery and setup;
- Free of overhead hazards (trees, branches, rooflines, power lines, overhangs);
- Free of underground hazards/utilities (sprinklers, septic, electrical, gas, water lines) and other obstructions;
- Suitable surface condition for safe anchoring and operation;
- Compliance with all local rules, property rules, and venue requirements.
Right to Refuse Unsafe Sites: Sponsor reserves the right to approve or deny an event site and to refuse setup where safety, access, surface, power, anchoring, weather, or operational requirements cannot be met.
Hard Surfaces / Special Anchoring / Indoor Setups: If stakes cannot be used or the site is turf, asphalt, concrete, indoor flooring, pavers, sand, or other non-stake surfaces, Sponsor may require sandbags, water barrels, specialty anchors, additional equipment, or additional labor. Additional fees may apply if required beyond what is included in the Prize package. Any required alternative anchoring or special setup is subject to Sponsor approval and availability.

Right to Refuse / Remove / Terminate: Sponsor may refuse setup, remove equipment, stop use, and/or terminate the rental without liability (and without obligation to provide the Prize on that date) if Sponsor determines, in its sole discretion, that conditions are unsafe or noncompliant, including without limitation: unsafe weather, unsuitable surface, inadequate anchoring, power issues, insufficient space, lack of supervision, misuse, rule violations, threatening conduct, or unsafe crowding. Winner is responsible for participant behavior and site conditions.
8) Weather Policy Integration (Controlling)
Sponsor’s existing weather and cancellation policy applies and is incorporated herein by reference as controlling. One Overall Winner: Sponsor will conduct one (1) drawing event on or about December 15, 2026 and will select one (1) potential Winner total. Sponsor will first randomly select which Entry Pool will be used for the drawing (Residential or Commercial), and then randomly select one (1) potential Winner from eligible Entries within that selected Entry Pool. The Winner will receive the Prize corresponding to the Entry Pool from which they are drawn.
Notification Methods: Sponsor will attempt to contact the potential Winner using the contact information provided in the Entry, including by email and phone, and may also use text message where a mobile number is provided. Verification: Sponsor may require proof of identity, age, eligibility, event county, and (if applicable) proof of site permission. Sponsor may also require the Winner to sign Sponsor’s standard rental agreement and a standard eligibility/liability/publicity release as a condition of prize redemption, to the extent permitted by law.
10) Publicity Release (Optional/Conditional)
Unless prohibited by law, Winner grants Sponsor permission to use Winner’s first name and last initial, city, and general prize redemption information for promotional purposes without additional compensation. If Winner voluntarily provides event photos or videos (or consents to Sponsor capturing them), Winner grants Sponsor the right to use such materials for marketing and advertising without additional compensation, unless prohibited by law. Winner may revoke optional photo/video permission by written request prior to publication, where feasible, by emailing info@backyardresponders.com.
11) Liability; Assumption of Risk; Indemnification
Assumption of Risk: Inflatables and event equipment involve inherent risks, including risk of injury. By entering and/or accepting a Prize, Entrant/Winner acknowledges and assumes all risks associated with participation and/or use of the Prize, including risks arising from participant behavior, supervision, site conditions, weather, and misuse.
Limitation of Liability: To the fullest extent permitted by Kentucky and federal law, Sponsor (and its owners, officers, employees, and agents) shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages; lost profits; or any damages arising out of or related to the Giveaway, entry, Winner selection, Prize acceptance, Prize use, or inability to use the Prize, even if advised of the possibility of such damages. Sponsor’s total liability for any claim shall not exceed the lesser of the stated Prize value applicable to the Winner or $100, to the extent permitted by law. Some jurisdictions do not allow limitations on certain damages; these limitations apply to the maximum extent permitted.
Release: By entering, Entrant releases Sponsor and the Beneficiary from claims arising from participation in the Giveaway and Prize use, except where prohibited by law.
